Insurance and Tax Registration
Shutter Dreams Photography is tax registered. Shutter Dreams Photography is fully insured through Hiscox insurance for photographers.
Copyright
Shutter Dreams Photography retains rights pertaining to the digital images and may use the images for future promotion of the business, including physical and digital display.
The client is granted the right to use the photographs for personal use, provided that they do not edit the photographs. Third parties may also use the photographs for personal use, again provided they do not edit the images.
Liability
Shutter Dreams Photography is not liable for any loss of profit, loss of contract, loss of business or loss of goodwill or for any indirect or consequential losses or damage or any other claims from third parties arising out of or in connection connection with this agreement. Total liability for all losses, claims, damages, costs and expenses arising out of or in connection with the agreement will not exceed the total amount of fees paid. Nothing limits or excludes liability for death, personal injury or other losses not able to be excluded or limited by law.
Expenses
Client will reimburse the Business for reasonable expenses incurred by the Business in the provision of services under this Contract.
Invoices
The Business will invoice the Client after completion of milestone(s) or the Project, unless otherwise noted in the Payment schedule. The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension or termination of the Project.
Payment methods
Payment will be made to the Business via cash, check, an approved payment card, or by any other payment method determined by the Business.
Cancellation of booking
If the booking is cancelled within 1 day of the service, the service cost will be non-refundable.
Rejections
The client may request further reasonable editing of images. This will be at the discretion of Shutter Dreams Photography, who retain the right to refuse further editing. Photographs are a custom product that cannot be refunded.
Modifications
The Client and the Business must agree to any changes to this contract in writing.
Force Majure
Shutter Dreams Photography is not liable for a failure or delay in performance due to any circumstances beyond reasonable control. If unable to perform the service because of illness, emergency or an act of God, Shutter Dreams Photography will take all reasonable steps to re-schedule and if this is not possible, then a refund will be issued. If Shutter Dreams Photography experiences equipment failure or other technical issues that limits the service, then this will be taken into account, measured, and potentially involve refunding part of the fees - liability will be limited.
Applicable law of jurisdiction
The Agreement (including any non-contractual rights and obligations) arising out of or in connection with it, its subject matter or formation shall be governed and contoved in accordance with Scots Law. The parties agree that the coneti of Scotlandhave exclusive jurisdiction to hear, settle and/or determine any dispute, arising out of or in connection of this Agreement (including any non-contractual disputes or claims).Â
Warranty
No refunds will be provided for the work completed or services performed under this contract and in accordance with your consumer rights (this does not affect your cooling off rights).
Terms Prevail
These terms apply to the Agreement to the exclusion of any terms and conditions put forward by the client.
Confidentiality and Data Protection
Shutter Dreams Photography/James Thomson will keep confidential and not disclose to any 3rd Parties or make any use of any material or information disclosed or communicated except for the purposes of fulfilling the Agreement. Any information (including personal data) shall be kept in accordance with the data protection principles set out in the Data Protection Act 2018 and UK GDPR.
